Terms and Conditions
Baby Information Bank (“the Company”) reserves the right to alter or reclassify any advertisement and/or listing order to conform with the Company’s policy. The placing of an order for an advertisement and/or listing by an Advertiser constitutes a warranty by the Advertiser to the Company that the advertisement and/or listing is legal, decent, honest and does not contravene the British Code of Advertising Practice or any current legislation. In particular, the reproduction and/or publication by the Company of each Advertisement and/or Listing placed for publication by an Advertiser with the Company will not breach any contract or infringe or violate any copyright, trademark or any other personal or proprietary right of any person or render the Company liable to any proceedings whatsoever.

The Advertiser represents and warrants the Company that the Advertisement and/or Listing complies with the requirements of all relevant legislation (including subordinate legislation, the rules of statutory authorities and the law of the European Union) for the time being in force in the United Kingdom.

Advertisers are requested to check their Advertisement and/or Listing the first day it appears on the website and the Company will not be liable for any error in the Advertisement and/or Listing. Furthermore the Company does not accept liability for any loss or damage caused by an error or inaccuracy in the publication of any Advertisement and/or Listing. The Company’s agreement to publish the Advertisement and/or Listing is conditional upon the Company first seeing the proposed Advertisement and/or Listing and approving it. The Company further reserves the right to refuse part or all of the Advertiser’s artwork or copy for whatever reason in its sole discretion.

If the Company is required by the Trading Standards Authorities, or the Police, or any other similar person, authority or body, to disclose information relating to any Advertisement and/or Listing, the Advertiser authorises the disclosure of such information and acknowledges that the Company will be acting in good faith in making such disclosure and acknowledges that the Advertiser has no right or cause of action in respect of disclosure.

The Company does not accept responsibility for damage to or loss of artwork, photographs or other materials of the Advertiser, howsoever caused. Any Advertiser providing such materials warrants that they have retained the same in sufficient quality and quantity for whatever purpose. All orders for Advertisements shall be accepted and published at the rates that are currently operative.

The Advertiser agrees to indemnify the Company in respect of costs, damages or other charges falling upon the Company as a result of any legal action arising from publication of Advertisements and/or Listings.

All Advertisements and/or Listings placed on the website are accepted on the strict understanding that every Advertiser will comply with the word and spirit of the Sex Discrimination Act 1975, the Equal Pay Act 1970, the Race Discrimination Act 1976, the Disability Discrimination Act 1995 and their subsequent Acts and all other relevant applicable laws and legislation. All Advertisements and/or Listings will be accepted only on the express condition that the Advertiser warrants the Advertisement and/or Listing does not in any way contravene the provision of the Trade Descriptions Act 1968 or any subsequent legislation. Advertisements and/or Listings for the sale of goods or service are accepted only on the condition that if the Advertiser is trading in the types of goods concerned, this fact will be clearly indicated in the Advertisement and/or Listing subject to the Business Advertisement Disclosure Order 1977 and any subsequent legislation.

The placing of an order either verbally, electronically or written for the publication of an Advertisement and/or Listing onto the website shall constitute an acceptance of these conditions. All Advertisements and/or Listings must be prepaid. No Advertisements and/or Listings will be published on the website until full cleared payment has been received. VAT, if applicable, shall be added to all Advertisements at the current rate in force. The Company reserves the right to increase or change charges without any prior notification.

These Terms and Conditions shall be interpreted in accordance with and governed by English Law.
